Kenneth Eugene Foster, un ragazzo afroamericano di 30 anni, sarà messo a morte il prossimo 30 agosto. Foster è stato condannato nel 1997 per complicità nell’omicidio di Michael LaHood, bianco, avvenuto nel 1996. Mauriceo Brown, la persona che sparò a LaHood, è stato messo a morte nel 2006.
Foster, che era in macchina a circa 30 metri di distanza dal luogo in cui fu commesso l’omicidio, è stato condannato a morte secondo la "Law of parties", una legge texana del 1974, secondo la quale non c’è differenza tra chi commette il reato e chi, invece, ne è complice in modo consapevole e premeditato; entrambi vengono egualmente ritenuti colpevoli dello stesso crimine. Foster ha sempre dichiarato di non essere a conoscenza delle intenzioni di Brown e di non sapere se Brown volesse rapinare o uccidere LaHood. Esistono prove che non sono state presentate al processo secondo le quali l’omicidio non è il risultato di un atto intenzionale. Lo stesso Brown ha sempre dichiarato che, quando scese dalla macchina per rapinare LaHood, non aveva intenzione di ucciderlo.
Brown e Foster furono processati insieme con l’accusa di omicidio. Brown ammise di essere l’esecutore materiale del crimine, mentre Foster si dichiarò non colpevole. Entrambi furono condannati a morte. Julius Steen e DeWayne Dillard, gli altri due complici presenti in macchina al momento del crimine, non furono processati per l’omicidio.
Per condannare a morte Foster secondo la "Law of parties", il procuratore si basò sulle prime confuse dichiarazioni di Steen. In seguito, Steen ammise che non era sicuro né delle intenzioni premeditate di Brown, né che fu Foster a prevedere un omicidio a conclusione della rapina. Tuttavia, Steen non fu ascoltato dalla difesa di Foster e Dillard non testimoniò nemmeno al processo. Questo accadde perché entrambi erano sotto processo per altri reati e gli avvocati negarono loro il permesso di essere ascoltati mentre i procedimenti penali erano in corso.
In seguito, entrambi hanno rilasciato dichiarazioni che scagionano completamente Foster dalle accuse basate sulla "Law of parties". Secondo queste dichiarazioni, nessuno in macchina era a conoscenza delle intenzioni di Brown, non c’era stata nessuna discussione o previsione dell’omicidio e Brown tornò sconvolto in macchina perché non aveva immaginato che la rapina potesse concludersi con l’omicidio di LaHood.
Dal 1977, anno di ripresa delle esecuzioni negli Usa, sono 1089 i prigionieri messi a morte; di questi, 398 nel Texas. Nel 2007, ci sono state 32 esecuzioni negli Usa, di cui 19 in Texas. Le Salvaguardie Onu per la garanzia della protezione dei diritti dei condannati a morte dichiarano che “la pena capitale deve essere imposta soltanto quando la colpevolezza dell’imputato è basata su prove chiare e convincenti che non lascino spazio a ricostruzioni alternative dei fatti”.
Kenneth Foster non ha ucciso Michael LaHood ed esistono prove convincenti che Foster non abbia pianificato nessun atto criminoso. Non aveva intenzioni, né prevedeva di commettere una rapina, né tanto meno un omicidio.

Dear Ms Owens,
I'm writing to you as a supporter of Amnesty International, the non governmental organization which since 1961 has been working in defense of human rights, wherever they are violated.
I would like to draw your attention to the case of Kenneth Foster, inmate number #999232, that will be executed the next 30th August.
I express sympathy for the family of Michael LaHood, I’m not seeking to excuse the manner of his death or to downplay the suffering it will have caused.
The person who actually shot Michael LaHood, Mauriceo Brown, was executed last year. I express my deep concern at the use of the law of parties in this case, I would to call your attention to the evidence that the shooting was the spontaneous act of Mauriceo Brown, and that all those involved in the crime have said that there was no conspiracy to rob Michael LaHood, which would make Kenneth Foster innocent of capital murder.
Furthermore, I note that the two other accomplices in the car were never prosecuted in this crime, and yet as the evidence stands today their and Foster’s culpability in it would appear to be similar or the same.
For all these reasons, I call for Kenneth Foster to be granted clemency.
